BIMCO has introduced a new Biofuel Clause for Time Charter Parties as the maritime sector increases its use of low-carbon fuels and works to meet decarbonization goals.
The new clause is designed to address the legal and operational challenges tied to integrating biofuels into shipping contracts, an issue that has gained urgency as regulatory changes continue to shape fuel strategies across the industry.
Biofuels are emerging as a key option for reducing emissions in marine transport, but their use can create uncertainty for shipowners and charterers. Questions around fuel quality, engine compatibility and liability have become more common as adoption grows.
BIMCO said the clause establishes a framework to help both parties manage those concerns. It includes clear fuel definitions and agreed specifications aligned with ISO standards, creating a common reference point for fuel quality and performance.
The clause also outlines procedures for sampling, testing, storage and handling of biofuels, aiming to reduce disputes and improve consistency in operations.
In addition, it introduces mechanisms for adjusting vessel performance when fuels with different calorific values are used. This includes provisions to fairly revise existing speed and fuel consumption warranties under charter agreements.
The new framework reflects the broader shift toward alternative fuels across the transportation and logistics sectors, where biofuels are expected to play a larger role as companies seek lower-carbon solutions. For grain processors and biofuel producers, increased demand from shipping could create additional market opportunities as marine operators expand their fuel options.
